Data protection
The protection of your personal data is very important to us, which is why we strictly adhere to data protection regulations, in particular the General Data Protection Regulation (GDPR) and federal and state data protection laws. 1. Data collection
a. Personal data can be used to identify a person. Such personal data includes name, address, email address, telephone number and IP address.
b. We require the data you voluntarily provide in order to fulfil our contractual obligations arising from the client relationship. The data is collected, stored and processed by us. When you engage our services, we collect your name, address, telephone number, fax number, email address and date of birth, provided you supply this information. In various areas of law, the processing of other, more sensitive personal data – e.g. tax number, illness/injury diagnoses, previous criminal convictions, entries in the driver suitability register, religious affiliation, account details and information from registers – is conceivable. This list is not exhaustive.
2. Purpose/legal basis of processing
The purpose of processing personal data is to fulfil our contractual and pre-contractual obligations arising from the client relationship. Further purposes of data processing are compliance with accounting and tax regulations.
3. Data use and transfer
a. With a few exceptions, lawyers are generally bound to secrecy.
b. We therefore do not pass on your personal data to third parties unless you agree to this or request us to do so, or unless this is necessary to fulfil the contractual obligations arising from the client relationship, e.g. when enforcing your claims against third parties or when commissioning an expert.
c. Data processing is carried out by us. Insofar as we use so-called contract processors to process your data, we have contractually obliged them to comply with data protection regulations.
4. Data storage / technical and organisational measures
Our server, on which the data is stored in encrypted form, is located within the EU and is therefore subject to the General Data Protection Regulation. We take further technical and organisational measures in line with the state of the art.
5. Duration of processing
Once the client relationship has ended, the data stored about you will only be retained for as long as there is a need for storage, e.g. due to professional, tax or liability law requirements.
6. Rights of data subjects
Due to data protection regulations, we would like to draw your attention to the following rights:
- Right to information: You can ask us what personal data we hold about you. We have one month to respond to your request.
- Right to rectification: If we have stored incorrect personal data about you, you have the right to have the incorrect data rectified.
- Right to erasure: You have the right to have your personal data erased, unless we have legitimate interests that prevent this (see section 5).
- Right to restriction of processing: You may request that your data be processed only to a limited extent, unless this conflicts with our legitimate interests (see Right to erasure).
- Right to data portability: You also have the right to have us transfer your data to third parties. The data will be provided in a structured, commonly used and machine-readable format for this purpose.
- If your personal rights are violated by a breach of data protection regulations, you may be entitled to compensation.
- In the event of a breach of data protection regulations, you can lodge a complaint with the competent supervisory authority (State Commissioner for Data Protection and Freedom of Information Rhineland-Palatinate, Hintere Bleiche 34, 55116 Mainz).
